1. Acceptance of Terms

By accessing or using KindRoster ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including organizations, administrators, and volunteers.

2. Service Description

KindRoster provides a cloud-based volunteer management platform designed for nonprofit organizations. The Service includes features for:

  • Managing volunteer profiles, applications, and onboarding
  • Creating and scheduling volunteer opportunities
  • Tracking volunteer hours and generating reports
  • Communicating with volunteers via email and optional SMS
  • Storing documents and managing organizational data

3. Account Registration & Security

To use KindRoster, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account
  • Not share your account with others or create multiple accounts

You must be at least 16 years old to create an account. Organizations are responsible for ensuring volunteers using the platform meet this age requirement.

4. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to harass, abuse, or harm others
  • Collect or harvest personal information from other users
  • Impersonate any person or entity
  • Use automated systems (bots, scrapers) without permission

5. Your Data & Content

You retain all rights to the data and content you upload to KindRoster ("Your Content"). By using the Service, you grant us a limited license to:

  • Store, process, and display Your Content as necessary to provide the Service
  • Create backups and ensure data security
  • Use anonymized, aggregated data for service improvements

You are responsible for:

  • Ensuring you have the right to upload and share all content
  • Obtaining necessary consents from volunteers for data processing
  • Complying with applicable data protection laws (GDPR, CCPA, etc.)
  • Maintaining backups of critical data

6. Subscription & Payment

KindRoster offers subscription-based pricing:

  • Free Trial: 14 days with full access to all features, no credit card required
  • Monthly Plan: $95/month, billed monthly
  • Annual Plan: $90/month ($1,080/year), billed annually

By subscribing, you agree to:

  • Provide valid payment information
  • Authorize automatic recurring charges
  • Pay all fees on time

Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds for partial months or unused time.

7. Service Limitations

To ensure quality service for all users, the following limits apply:

  • Volunteers: Up to 10,000 volunteer records per organization
  • Storage: Up to 10GB of file storage

8. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance or experience unexpected downtime. We are not liable for any damages resulting from service interruptions.

9. Intellectual Property

KindRoster, its logo, and all related content, features, and functionality are owned by Knot Speed Labs LLC. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Termination

We may suspend or terminate your access to the Service if you:

  • Violate these Terms of Service
  • Fail to pay fees when due
  • Engage in fraudulent or illegal activity
  • Create risk for other users or the Service

Upon termination, your right to access the Service ceases immediately. We will provide a reasonable opportunity to export your data before deletion.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINDROSTER AND KNOT SPEED LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless KindRoster and Knot Speed Labs LLC from any claims, damages, losses, or expenses arising from your use of the Service, violation of these terms, or infringement of any rights of others.

14. Changes to Terms

We may modify these Terms of Service at any time. We will notify you of significant changes via email or through the Service. Your continued use after such changes constitutes acceptance of the modified terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in the applicable jurisdiction.
